1. TERMS OF SERVICE

1. Acceptance of Terms

By accessing xtdvoice.com ("Site") or engaging the services of Xtended Voice Services ("XTD Voice," "we," "us"), you ("Client" or "User") agree to be bound by these Terms of Service ("Terms").

2. Description of Services

Xtended Voice Services provides communication solutions, answering services, and virtual receptionist technologies. We may utilize a combination of live agents and Artificial Intelligence (AI) to route messages according to your instructions.

No Emergency Services: You acknowledge that Xtended Voice Services is not a replacement for traditional telephone service. Our agents and systems are not trained or equipped to handle emergency calls (911).

3. User Responsibilities

Account Security: You are responsible for maintaining the confidentiality of your account credentials.
Accurate Instructions: You are responsible for providing clear scripting instructions. XTD Voice is not liable for errors resulting from outdated or ambiguous instructions provided by you.

4. Call Recording and Monitoring

Consent: You acknowledge that XTD Voice may record calls for quality assurance and training.
Compliance: You represent that you will notify your own callers that their calls may be recorded, as required by applicable laws. You agree to indemnify XTD Voice against any claims arising from a failure to notify callers.

5. Acceptable Use (TCPA Compliance)

You are strictly prohibited from using XTD Voice to:

Transmit unsolicited marketing calls, robocalls, or spam (violation of TCPA).
Harass or abuse our employees or automated systems. We have a zero-tolerance policy for abuse toward our staff.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, XTENDED VOICE SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

7. Governing Law

These Terms shall be governed by the laws of the State of Michigan. Any legal action will be brought exclusively in the courts located in Macomb County, Michigan.

1. Transparency of AI Use

Identification: Our AI systems are designed to identify themselves as automated assistants where legally required.

2. Accuracy and Reliability (Disclaimer)

Potential for Error: AI systems may occasionally generate incorrect or contextually irrelevant responses ("hallucinations").
No Guarantee: Xtended Voice Services does not guarantee the complete accuracy of any text or voice response generated by our AI tools.
Verification: You acknowledge that AI summaries should be verified by a human before being relied upon for critical decisions.

3. Not Professional Advice

Responses generated by our AI should never be interpreted as professional legal, medical, or financial advice.

4. Limitation of Liability for AI

Xtended Voice Services shall not be liable for:

Misunderstandings caused by the AI’s failure to understand accents or phrasing.
Actions taken by you based on erroneous information provided by the AI.
